Release of Liability Clause
The Member understands and agrees that participation in Brazilian Jiu Jitsu (BJJ) training and use of the facilities provided by 4 Brothers BJJ, LLC involves inherent risks of injury, illness, or other harm. These risks include, but are not limited to, physical contact with other participants, equipment-related accidents, slips, falls, and potential exposure to infectious diseases.
In consideration for being permitted to participate, the Member voluntarily assumes all risks and releases, waives, and discharges 4 Brothers BJJ, LLC, its owners, instructors, staff, affiliates, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury—including death—that may be sustained while on premises or engaged in gym-related activities, whether caused by negligence or otherwise.
This release shall be binding upon the Member’s heirs, legal representatives, and assigns. The Member acknowledges they have read and understood the terms of this Release of Liability and voluntarily agree to them by signing below.
If the Member is under 18 years of age, this release must be signed by a parent or legal guardian who affirms their authority and agreement to the terms above on behalf of the minor.
Photo/Media Release
I, {name}, grant permission to 4 Brothers Brazilian Jiu Jitsu, LLC, its team, and affiliated organizations to take photos, record videos, or capture my likeness while I’m participating in activities at Brothers Brazilian Jiu Jitsu or events related to it.
I understand these images or recordings may be used by 4 Brothers Brazilian Jiu Jitsu, LLC for marketing, educational, or promotional purposes across various platforms, such as websites, printed materials, or social media. I waive any right to review, approve, or receive compensation for such use, and I release 4 Brothers Brazilian Jiu Jitsu, LLC from any claims related to the use of my image.
By signing below, the Member acknowledge this release remains valid unless I notify 4 Brothers Brazilian Jiu Jitsu, LLC in writing at 4brosbjj@gmail.com.
CANCELLATION POLICIES
STANDARD CANCELLATION: YOU MAY CANCEL THIS CONTRACT WITHOUT PENALTY OR OBLIGATION WITHIN THREE (3) BUSINESS DAYS AFTER THE DATE OF THE CONTRACT, EXCLUDING SUNDAYS AND HOLIDAYS. ALL UNUSED FUNDS WILL BE RETURNED WITHIN THIRTY (30) DAYS FROM THE DATE OF CANCELLATION. ANY MONEY PAID IN ADVANCE WILL BE REFUNDED PRO RATA. WRITTEN NOTICE OF CANCELLATION MUST BE SENT BY CERTIFIED MAIL TO 4 BROTHERS BJJ, 117 EAST ST., STE 250, HUTTO, TX, 78634. YOU MAY ALSO CANCEL THIS CONTRACT BY EMAILING NOTICE TO 4BROSBJJ@GMAIL.COM OR PROVIDING IN-PERSON NOTICE AT THE FACILITY.
RELOCATION OR FACILITY CLOSURE: YOU MAY CANCEL THIS CONTRACT AND RECEIVE A FULL REFUND OF ALL UNUSED FUNDS IF 4 BROTHERS BJJ GOES OUT OF BUSINESS, MOVES MORE THAN 10 MILES FROM ITS LOCATION, OR IF YOU MOVE YOUR RESIDENCE MORE THAN 25 MILES FROM THE HEALTH SPA. TO CANCEL, YOU MUST PROVIDE WRITTEN NOTICE. WRITTEN NOTICE MUST BE SENT BY CERTIFIED MAIL TO: 4 BROTHERS BJJ, 117 EAST ST., STE 250, HUTTO, TX, 78634. YOU MAY ALSO CANCEL THIS CONTRACT BY EMAILING NOTICE TO 4BROSBJJ@GMAIL.COM OR PROVIDING IN-PERSON NOTICE AT THE FACILITY.
DEATH OR DISABILITY: IF YOU DIE, BECOME TOTALLY AND PERMANENTLY DISABLED, OR BECOME PHYSICALLY UNABLE TO USE THE SERVICES FOR A PERIOD OF THREE MONTHS OR MORE DUE TO A SIGNIFICANT PHYSICAL DISABILITY CERTIFIED BY A LICENSED PHYSICIAN, YOU OR YOUR ESTATE MAY CANCEL THIS CONTRACT. THE HEALTH SPA MAY REQUIRE REASONABLE PROOF OF DISABILITY OR DEATH. TO CANCEL, YOU MUST PROVIDE WRITTEN NOTICE. NOTICE MUST BE SENT BY CERTIFIED MAIL TO: [117 EAST ST., STE 250, HUTTO, TX, 78634]. YOU MAY ALSO CANCEL BY EMAILING NOTICE TO 4BROSBJJ@GMAIL.COM OR PROVIDING IN-PERSON NOTICE AT THE FACILITY. ALL UNUSED MEMBERSHIP FUNDS WILL BE REFUNDED WITHIN 30 DAYS OF THE DATE THE NOTICE IS RECEIVED.

Cancellation at Owner’s Discretion: 4 Brothers Brazilian Jiu Jitsu, LLC reserves the right to cancel or terminate a membership at any time, at its sole discretion, if it determines that a Member’s conduct is inconsistent with the values, safety, or operational standards of the facility. Grounds for termination may include, but are not limited to, violation of facility policies, disruptive behavior, failure to comply with safety protocols, or conduct that jeopardizes the well-being of other members or staff. If a membership is terminated under this clause, any unused portion of prepaid dues may be refunded, prorated at the discretion of 4 Brothers Brazilian Jiu Jitsu, LLC. The Member will be notified of cancellation in writing, along with any refund terms if applicable.

By signing below, Member acknowledges receipt and understanding of terms, and confirms that the facility complies with Texas Health Spa Act requirements.
